1. Acceptance of Terms

By downloading, installing, or using Fit by Weather ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

Fit by Weather is a mobile application that provides AI-powered outfit recommendations based on weather conditions and your personal wardrobe. The App analyzes photos you provide to build a digital wardrobe and suggests appropriate clothing combinations.

3. User Accounts

To use certain features of the App, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. User Content

You retain ownership of all photos and content you upload to the App. By uploading content, you grant us a limited license to:

• Process and analyze your photos for wardrobe identification
• Store your photos securely for App functionality
• Use your content to provide personalized recommendations

You represent that you have the right to upload any content you provide and that such content does not violate any third party's rights.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Upload content that is illegal, harmful, or offensive
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Reverse engineer or attempt to extract source code
• Use the App to infringe on others' intellectual property rights

6. AI-Generated Recommendations

Outfit recommendations are generated by artificial intelligence and are provided for informational purposes only. We do not guarantee that recommendations will be:

• Suitable for all occasions or weather conditions
• Aligned with your personal preferences
• Accurate in all circumstances

You are solely responsible for your clothing choices.

7. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by Iora AI and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

8. Third-Party Services

The App uses third-party services including OpenAI, Google Cloud, AWS, and OpenWeather. Your use of the App is also subject to these third parties' terms and policies.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless Iora AI from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App at any time, without notice, for any reason. You may delete your account at any time through the App's settings.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the appropriate courts.
